Once again the idea of smoking in casinos has come to a head with the inclusion of a court case. This time a dealer from Caesars Palace Casino on the lost Vegas strip is now suing the company Harrah’s entertainment or been subjected to secondhand smoke.

Now that the case is filed the attorney for Tomo Stephens is gathering sources for a class action lawsuit against the casino. Tomo was a former blackjack dealer at Caesars Palace Casino and is fighting the case to find smoking areas for casino employees.

“The point of this lawsuit is not to ban smoking in casinos,” said Jay Edelson, a Chicago-based attorney who filed the action. “The real goal is to change what they’re doing. At least offer areas that are nonsmoking where employees can circle in and out. We are not trying to stop smokers from gambling.”

The lawsuit was filed in US District Court in lost Vegas, Harrah’s is not only taking away the non-smoking sections of the casino they are also encouraging players to smoke while gambling. In the past years a multi-casino study was performed to determine the secondhand smoke in the bloodstreams of people who were exposed to it.

According to the study done on three casinos, when smoke exists on the casino floors it also will exist in the bloodstreams of the casino employees through secondhand smoke. “We are not asking that Caesar’s Palace become smoke-free,” Edelson said. “They must take steps to protect the health of their employees. That’s reasonable and it’s humane.”

Stephens is fighting the lawsuit after long-term exposure to secondhand smoke throughout her career. She was then forced to quit her job in June and diagnosed by a physician as having pre-cancerous cells in her stomach. The physician therefore told her that she needed to remove herself from the casinos and further exposure to secondhand smoke.

Golden Nugget Casinos Take A Beating

Land-based casino gambling a taken a rather large hit in the past couple years due to the recession. Recently revenue generated at the Golden Nugget in Las Vegas and Laughlin dropped nearly 15.1% to $56.5 million. Rather than taking responsibility for itself, the Golden Nugget has blamed the second quarter findings on competitors and customers who are unwilling to spend their money.

According to Tilman Fertitta , Landry’s President and Chief Executive Officer stated, “I feel very good about restaurant hospitality; I do not feel very good about gaming.”

The drop that occurred in the second quarter of this year for Landry’s Hotel and Casino showed a significant decrease from $308.1 million at this time last year compared to $282 million this year in the second quarter. The share earnings also significantly decreased from $.74 down to $.23.

Along with the Golden Nugget casinos, Landry’s owns 175 restaurants as well as amusement parks. As the CEO mentioned he is not concerned about the revenue generated by the restaurants, merely the revenue generated by the casinos.

After hurricane Ike struck last year in Galveston Texas, many of Landry’s restaurants needed to be closed. The timing of this event coincided with a decline in the economy therefore affecting the company. This decline caused many gamblers to stay away from casinos and possibly convince more to join online casinos. The restaurants did recover through a series of promotions and advertisements.

“At Saltgrass, we did do some advertising that tremendously helps,” said Fertitta. “We had pulled back a lot of advertising because we didn’t know necessarily if it would pay for itself.”

Another area that the casino company is being hurt is in trying to be competitive with other established casinos. At the economy has become depressed many casinos have lowered their rates in an attempt to draw in more customers during these meager times. “You ought to go online and look at some of these rates and packages you can get,” Fertitta said. “That is where we are just being murdered, trying to be competitive with the MGM and the Bellagio.”

In order to keep up with the rest of the world, Spain is working diligently to launch online casino gambling in their country. Government regulation of online gambling has been a factor that has kept them back from competing with other markets. Taking tips from the European market which has the largest online casino gambling population anywhere else in the world, Spain is working on the localized version of rules and regulations.

Another issue that has been discussed with online casino gambling has been outsourcing of money where casino organizers will set up a local shop and then dump all the money offshore. In doing so local communities will not benefit from the online gambling is all the money will be put into offshore accounts.

“Never has the need for localization been more apparent in our industry, and iGB España is a timely reflection of this shift in focus.” James McKeown Editor for iGaming Business and iGB Affiliate Magazine, stated, “Spain is a flowering market but there is still much to learn in order to create a successful and fully compliant business there. Being the first market-specific conference on the circuit, iGB España is the only event fully dedicated to the Spanish market, and is the only place where you’ll be fully educated on the legal, operational and technical workings of the market.”

Through opening the Spanish market the online casino industry will suddenly be interested in tapping into a new country. This opens up the opportunity for more language casino games as well as different types of currencies. The ability for expansion grows exponentially as we have seen with other countries joining the online gaming industry. Such organizations as William Hill have already been planting the seed for expansion. Companies like these have the capital to quickly expand and take over a market thereby dominating the online casino industry.

Author: Chris  //  Category: Online Casino News

Online gambling industry executives are trying to spread the word and pull the masses that are interested in moving the game of poker out of the realm of illegal gambling. The Poker Players Alliance (PPA) recently was interviewed about their fight for the legalization of online casino gambling.

Leading the charge was Executive Director at CasinoAffiliatePrograms.com who spoke out about the legalizing of the online casino play.

John Pappas was featured in the interview for CAPTV channel and spoke of how online gambling needs to be available to the public. His view was to create a forum where gamblers can voice their own concerns and actually be heard. “We’re really encouraging the poker community to stand up for our game now by signing up for our petition,” said Pappas.

One way to voice your concern is, “You can go to PokerPetition.com where we have a quarter of a million Americans who have signed the petition [addressed] to President Obama.”

The hopes of the petition is to make the legislative executives aware of the amount of interest involved in the legalization of line casino gambling.

The plan of attack is, “We’re going to deliver [the petition] to him on National Poker Week so we’re building up to that. During National Poker Week, we’re asking people to write letters and call their Members Of Congress and do that right through our website, ThePPA.org.”

“We’re happy to provide the PPA with a forum for getting the message out about National Poker Week,” said Bob Rains, Senior Vice-President Of Marketing for CasinoAffiliatePrograms.com.

The plan is to encourage online casino gamblers to stand up for their rights as citizens of the United States, a right that was earned through centuries of wars. “We here at CasinoAffiliatePrograms.com also support the larger effort to get online poker fully legalised in the United States. Not only is this goal of direct interest to all of us in Internet gambling and poker affiliate marketing world, it’s also a worthy cause for American civil liberties in general.”

In outlining the latter for the casinos, Sayre is trying to leave the door wide open for the casinos will hopefully express these general aspects of concern as well as more specific areas that need to be put under the microscope. “There are often times interpretation issues that clearly some open dialogue would help,” Sayre said. “I thought it would be healthy to do something like this if the industry had an interest.”

The letter in question is a response to the most recent activity concerning Planet Hollywood resort where a $750,000 fine was paid in Nevada Casino regulators for failing to properly conduct themselves at a nightclub. Planet Hollywood resort is owned and operated by third party company, however they are still responsible for the dealings that happen within the casino.

The court case involving the Planet Hollywood resort and Casino dealt with nine counts of violations. Among the violations were specific instances of neglect of customers. Some complaints were filed pointed to nightclub employees who ejected customers from the nightclub were drunk and disorderly conduct, and place them in the casino area unattended. By failing to ask security to remove them if found in violation of the rules and regulations as well as displaying neglect following through on their positions.

Now with Sayre’s lead, the land-based casinos will have an opportunity to discuss these matters as well as other areas of concern.”I felt it appropriate that the whole industry didn’t get focused on just one area,” Sayre said. “There were some other areas that clearly both the regulatory system and the industry could benefit from some open dialogue.”

The MGM Mirage stands behind Sayre and the Gaming Control Board on this issue. “We value the guidance the (gaming control) board has given to date,” Monet said. “We look forward to continuing these discussions.” Other casinos will likely participate as a show of good faith towards improving the overall quality within the casino gambling industry.

Las Vegas Nevada has been a recent crackdown by the gaming control Board against illegal activity. Two weeks ago a land-based casino on the Las Vegas strip busted for improper control of illegal activity at the club. Due to this incident and other speculation the gaming control Board are considering imposing serious rules and regulations to keep the Las Vegas casinos safe.

The first step in the process of eliminating these regulatory concerns will be to incorporate new seminars that will alert casinos of the regulation issues that they may be at risk of violating.

“It’s an invitation to open up some dialogue,” said state Gaming Control Board member Randall Sayre. “It’s appropriate that there is some avenue for not just us to dictate what we see as trends, but for the industry to come forward and say, ‘Hey, maybe you guys should interpret this for us so we know what we’re dealing with.’ “

Through open up this type of dialogue a state board hopes to alert the casinos and allow the maps you to speak up for themselves and begin to take their own measures protecting their hotel and casino properties. The strengthened my company at all activity that occurs on their property will be subject to these rules and regulations.

According to a letter that was released by Sayre through the regulatory control board, “Either through lack of knowledge or apathy, licensees are creating regulatory challenges in areas requiring corrective action in other areas beyond nightclubs.

The letter from Sayre alsostipulates that land-based casinos have him properly gone about providing misleading advertising, questionable sports book operations, intellectual property theft as well as the handling of certain promotions, tournaments and contests. All of these areas fall under the jurisdiction of the control board and are the responsibilities of the casinos to regulate.
