Delaware Gets Supreme Nod for Online Sportsbetting

Ever since the 2006 ban on gambling many states have been working diligently to overturn the ban and legalize gambling within their state. Although some states would like to see the full range of casino gambling including online casinos legalized, right now many states are just happy to accomplish small goals that show forward progress on the legalization of gambling.
As of May 28, 2009 The News Journal reported: “Delaware’s new sports betting law complies with the state’s constitution, the state Supreme Court has concluded in a ruling released this morning, paving the way for bets on football games and other sports as early as September.”
“In an advisory opinion signed by all five justices, the high court ruled that the sports betting law signed this month by Gov. Jack Markell would constitute a lottery, the only kind of sports gambling — besides bets on horse races — permitted under the constitution.”
The NFL and NCAA both spoke out about this law in the past weeks claiming that by introducing gambling into the sports arenas there would be issues that would affect the outlook of the game.
“An attorney for the National Football League had argued before the justices last week that sports betting involved too much skill to be considered a lottery whose outcome was based on chance.”
“The court ruled, however, that the constitution ‘allows lotteries to involve an element of skill, as long as chance predominates” and wrote that the games that are created for gamblers “must assure that chance is the predominant factor…’”
Many other states will such as Kansas have been dealing with similar situations involving casino style games and gambling. In such cases dealing with have been overturned due to the fact that poker was deemed a game of skill that also introduced an element of chance.
